Nagaland Health Services PILs closed by Gauhati HC Kohima Bench

The state has been instructed to fill open positions for medical workers after the Gauhati High Court Kohima Bench (GHCKB) closed a number of Public Interest Litigations (PILs) pertaining to Nagaland’s infrastructure and health services. “The State will take the necessary steps to fill the vacancies of medical personnel in accordance with the procedure laid down by law,” the Division Bench of Justices Parthivjyoti Saikia and Budi Habung said in their ruling concluding the case.

The petitioners’ attorney argued during the hearing that the State had fulfilled all the conditions for which the PILs were filed and that no more directives were needed. They did, however, ask the court to order the completion of the medical personnel recruiting procedure in accordance with the open positions. The National Health Mission (NHM) Nagaland’s Mission Director’s attorney responded by stating that the government had already taken action to fill the positions.

The bench agreed after hearing arguments from both parties that the batch of PILs was no longer necessary because the state had satisfied with all of the petitioners’ demands. The 34 PILs, which were first filed in December 2017, were crucial in bringing about a number of improvements in the state’s health system up until 2020. Among other things, the state’s only medical college, the Nagaland Institute of Medical Sciences and Research, was built under close supervision and monitoring, which accelerated its completion.
